CLEVELAND, October 28, 2002 - The Glidden Company, which does business in North America as ICI Paints, today announced that it has been dismissed from another high-profile lead paint lawsuit - this time less than two months after the City of Chicago filed it.

The City of Chicago filed its lawsuit in the Circuit Court of Cook County, Illinois on September 5, 2002 naming Glidden and a number of present and former lead pigment manufacturers plus a trade association. The City's complaint alleged that lead paint should be classified as a public nuisance and that the defendants should be held accountable for cleanup.

Chicago officials quickly moved to dismiss Glidden after finding that the company never manufactured or sold lead products for use in paint and was therefore not responsible for lead-related health issues. The case remains pending against the other defendants.

This decision in Chicago comes as a Rhode Island jury continues to debate whether or not lead paint constitutes a public nuisance. Glidden was dismissed from the Rhode Island case in February 2002 and therefore is not involved in the trial.

In the past year, Glidden has been dismissed from 13 lead paint cases in California, Illinois, Maryland, Mississippi, New Jersey, Ohio, Rhode Island and Texas.
